TERMS OF SALE
By placing an order for any goods on our website you are subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are estimates only. JARIERA we will not be responsible for any delays resulting from postal delays or force majeure.
When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.
The cost of the products may fluctuate with seasons. All prices advertised are subject to such changes.
The E-Gift Card credit is redeemable only towards the purchase of our products either on www.jariera.in or at our store. It cannot be used for partial payments on both the platforms.
a) Our Contract
A contract between us for the purchase of the goods will not be formed until your payment has been approved and our billing agent has debited your credit or debit card.
- Please note that items in your shopping cart are not reserved and may be purchased by other customers. After you place your order, you will be sent an email to confirm that your credit/debit card has been charged.
- Your card account is debited at the same time you submit your order on our Website. If your order has not been approved, you will be notified immediately via our Website. In the rare instance that your order is approved but any of the items you have ordered are not available, we will contact you immediately by email to arrange for a full refund or a product exchange, if preferred.
- Unless you cancel your order, acceptance of your order and completion of the contract between you and JARIERA will be completed when when we e-mail you to confirm that your order is in process
- The Website and communication are always conducted in JARIERA; therefore, the final sale contract will also be in English.
We reserve the right to not accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards.
b) Sale and Purchase of Goods
JARIERA ("Seller") hereby agrees to sell, and You ("Buyer") hereby agree to purchase, goods of the description and quantity described on the checkout window ("Checkout") and incorporated herein by this reference ("Goods") on the terms and conditions set forth in this Agreement.
c) Purchase Price
Buyer agrees to pay the Purchase Price of the Goods as posted on this website attached hereto.
d) Payment Terms
The total amount of the Purchase Price shall be payable in full by Buyer according to the payment due date stated at Checkout. In addition, Seller shall have the right to pursue any remedies available at law or as provided herein and shall be entitled to reimbursement from Buyer for Seller's costs of collection, including attorney fees, legal fees and costs and disbursements, if any.
e) Delivery
Unless otherwise agreed in writing, delivery shall be made in accordance with Seller's shipping policy in effect on the date of shipment. Delivery dates provided by Seller are estimates only. Seller will make reasonable efforts to deliver in accordance with such dates; however, Seller will not be liable for failure to deliver as estimated. Unless otherwise agreed in writing by Seller, Goods shall be packaged according to Seller's standards and practices.
f) Customs, Duties, and Taxes
The recipient is responsible for assuring that the product can be lawfully imported to the destination country. When ordering from jariera.com, the recipient is the importer of record and must comply with all laws and regulations of the destination country.
Orders that are shipped to countries outside of India may be subject to import taxes, customs duties and fees levied by the destination country. For international shipments, the customer is responsible for any customs duties/taxes applicable in their country. These taxes will be chargeable over and above the product/order price you pay.
Customs policies vary widely from country to country; the recipient should contact their local customs office in case of any formalities required. When customs clearance procedures are required, it can sometimes cause delays beyond our original delivery estimates.
If required, the recipient must submit social security number, tax ID or any such proof of address or business as required by their customs office to have the shipment cleared.

h) Colour Disclaimer
The colours of products you see on computer screen will vary slightly from those of the actual product. This is because of the difference in underlying technologies of computer monitors and fabric; monitors that are not properly calibrated also add to the difference in colours. In addition, the lighting used while taking photographs also factor in the final colour shown on the screen.
i) Price Disclaimer
While jariera.com makes every effort to ensure that the products are described and priced accurately, in the event that an item is deemed to be priced incorrectly jariera.com reserves the right to refuse the sale of that item.
j) Force Majeure
Seller shall not be held responsible for any failure of performance to make timely delivery of all or any part of the Goods in the event such failure was due, in whole or in part, to federal, provincial or municipal action, statute, ordinance or regulation, strike or other labor trouble, fire or other damage to or destruction of, in whole or in part, the Goods or the manufacturing facility for the Goods, the lack of or inability to obtain raw materials, labor, fuel, electrical power, water or supplies, or any other cause, act of God, contingency or circumstances not subject to the reasonable control of Seller, which causes delays or hinders the manufacture or delivery of Goods. Seller shall determine in good faith the extent to which it can reasonably control a cause, contingency, or circumstance that affects the performance of its obligations.
